ENEA punished for hampering creation of wind farms

The Court of Competition and Consumer Protection sustained a penalty of PLN 11.6 million imposed by the Office of Competition and Consumer Protection on the electricity company Enea Operator. The Office had decided that Enea Operator had been grossly violating deadlines as provided by law for issuing the conditions with regard to grid connections and for determining the influence of a designed wind farm on the power system, exceeding them sometimes even over a year. Actions of Enea Operator constituted an abuse of its market position through unlawful limitation of competition on the domestic market of power generation.
The Court entirely dismissed Enea’s complaint against the decision. The judgment is not lawful yet and an appeal may still be filed.
