The high turnout and numerous questions that appeared at today's @SPCC & @Linklaters Webinar: Remote work - the most common problems of employers showed just how important this topic is.
@Monika K @ Łukasz - thank you for the substantive and very practical "guide" to the applicable regulations and the best solutions.
Here's a quick summary of some of the basics:
Is it obligatory to draw up regulations for remote work?
NO. But such a document can be very helpful. Clear rules of remote work will help to avoid possible problems, e.g. related to the access of unauthorized persons to company data (when the employee works remotely from a public place, cafe, etc.), the inability of the employee to appear in the office on call (when it turns out that he works remotely, but from another city).
Can an employee work in quarantine if he is healthy?
YES. An employee in quarantine can work and is then fully paid. He may even use vacation leave during the quarantine. If he becomes ill during quarantine, he should go on a sick leave.
Can an employee claim an allowance for utility costs?
NO. There is no legal basis that would constitute the basis for such a request, but some employers use such solutions by paying e.g. a lump sum or covering the costs of Internet connection upgrade necessary for the effective performance of duties.
